I just found out about iHerp today.
It would not be so bad except that Aaron was an admin over at Chondroforums. If Aaron had no way of knowing about my applications prior to developing iHerp, then I wouldn't bother to complain. I would just assume he came up with the idea independently from me, but this is not the case. |

Web wheeler.chondroforum I can attest that Aaron has been working on this for years, and that I personally discussed it with him at length back in 2006, and I
demo'd working software then as an "alpha" tester (and it had LOTS of bugs then I can attest ;-) - but was essentially all in place in terms of
functionality.
Furthermore, any snake hobbyist with a web application or software background would have the idea of coding a web app that combines new social software approaches with tracking. In fact, when I first talked to Aaron in 2006 I had already sketched out the architecture for a similar app (I'm a software designer also). But since I have enough on my plate with my other project, and Aaron had already at that point come a long way in the build, I threw in the towel and let him run with it. I understand exactly how you feel though...last year when I first launched our elearning application there were many competing applications that had just come out, or were launching, that were very similar, and it was frustrating for me. I felt like "hey that's MY idea and you couldn't have the same idea because I own it". But what happens in the software field is that when the time is right, everyone gets the same idea. Aaron has been at this since at least 2003, maybe before, I can assure you.

I've been involved with iHerp for a number of years before it went live..since Tuesday, September 27th, 2005, to be exact. Like Cleve stated, he has been
at it since at least 2003, and anyone that knows Aaron would attest to the fact that he is nothing but a stand up guy, and he certainly would never rip anyone
off. He would not risk his reputation in the reptile community.
There will always be competition. People will find the application they want to use, be it iHerp or Breeding onLine, or any of the other programs out there. Kim "Wow, that is a hot snake, I would definitely hit that."

So Iherp rocks and I admit; Aaron is much smarter than he looks, (who knew?) but if Aaron ripped off anyone, it was me! On Monday, September 26th, 2005, I remember saying to Aaron: "Someone should like make a website with pretty pictures about snakes and stuff. That would be cool".Move ahead almost 3-years later, and that Peckerhead Aaron took my exact idea! Eventually I would have gotten around to creating a snake-computer thingy, but what's the point now? iHerp.com was registered in 2002, about a year or two after I had the idea. In 2005 I had my first test users sign NDA's to get the site going, and there is animal tracking in the system that dates back to 2005. Like Cleve said, anyone who's into computers and snakes knew this was coming, it was only a matter of time. That's the nutshell of iHerps backstory. Thanks to everyone else for the positive comments, glad you're enjoying the site! It'd definitely starting to get hopping with the new features put up last week, next release should be up on Monday... I have a few things in store that are going to be killer. Cheers, Aaron

Just to throw my 2 bits in here since I have first hand experience at the matter.
Even if it was reverse engineered to spec from an existing application, there is zero copyright protection for software "concepts". It is like the Ford family trying to sue someone for building an assembly line. Can't do it. I had someone that wrote an app that was almost identical to mine a few years back. I knew I had no recourse, but to bluff, I sent a cease order to the person citing infringement on my license agreement because this person had purchased my product. So due to that fact, there was a little legal gray area. Whether or not it had an impact, the app disappeared. In any event, the old saying goes... there are only so many ways to skin a cat. Fact. I've talked to Aaron at length about the project and was well aware of it for quite some time. I think it is great and he is the perfect person to take it where it needs to go. BTW, Aaron, speaking of NDA's, I got one the other day that will crack you up. I'll forward it to you. -d |

WebWheeler did post on ChondroWeb, where Aaron is a moderator (think in this case that's totally irrelevant) last November and had some very similar ideas.
iHerp did not launch publicly until April 2008, I can understand why he may have thought that his idea was copied/stolen. I saw the original post and remember
specifically thinking how similar it was to what I already knew Aaron was working on. I can attest to the fact that iHerp was very similar to what it is now
when I first signed NDA in November of 2006.
I do feel bad though that this has been brought up in a negative light though, I think iHerp is a wonderful site and know Aaron really worked hard to make it as user friendly as possible for all herpers. I felt real lucky to have been able to watch the development and launch, it was a long time in coming!! Thanks again Aaron, very well done!! |
